being cast into a police cell and forgotten, but it never has intended to preclude reasonable questioning_interrogation which might prove a man innocent, or mighr establish his guilt through incriminating statements or even, as in Mallory’s case, a full and voluntary confession, -There is, furthermore, an established right in the accused to contend in court that a oonfession offered in evidence against him is a fabrication, cr was extracted by force or ether cruel treatment, and to have the alleged confession barred from evidence if h.s claim is believed.
The bill recently passed by the House would not disturb these settled principles. It would provide only that confessions and other evidence obtained during quest-o:iing a suspect would not become invalid merely through the passage of time while he was in custody before being araigned in front of a magistrate.
The votes by which this bill, and the one based on tthe Steve Nelson case, were passed in the House demonstrates that concern over the type of judicial thinking which had dominated the Supreme Court in recent years no longer can be dismissed as “a Southern obsession” but reflects a broad solicitude for the tfitegrtiy of historic precepts of American law.
