Your orator Alfred M. Hickman, respectfully represents that he is chairman of the Republican Party of Rappahannock County and that—pursuant to Section 24-29 of the Code of Virginia—the Republican- Party is entitlei l to be represented by at least one member on the local electoral board. . ! ' * 2. On informat on and belief, your orator avers that two members of the Board beloni • to the Demooratic Party. The third member. Galley W. Smith, has purported to subscribe to the principles of the Republican Party atj times,although his actions have long indicated otherwise. 3. The Republ can Party of Virginia in its Party Plan, has laid down plain and definite qualifications for those who wish to engage in any activities within the party itself. All party members, if challenged at any official Republican meeting, must publicly state their intention to support all Republican candidates at the ensuing election; and the failure to so state this intention disqualifies them from membershhip in the Republcan Party. 4. At an official meeting of the Seventh District Republican Committee (which committee comprises all the county and city chairmen within the 7th District) held* in Luray in July of this year, the said Galley W. Smitjh appeared and spoke before the Committee regarding a matter within their Jurisdiction. Whereupon he was challenged, according to the Party Plan, to state his intention to support all the Republican nominees at the ensuing election. Mr. Smith refused to so state; thereby disqualifying himself from membership in the

Republican Party. { i ! 5. Your orator wrote to Mr, Smith and requested his resignation from the Board ;poipting out that it was unethical for him to remain a member of the Board after he had, by his own act, disqualified himself from membership within the Party. He was reminded that the Republican Party had an absolute right to membership on the Board as a matter of law. and that this right involved not only the current Republican nominees, but, in all probability, future nominees during the three year term; aqd further, that Governor Tuck had resigned as chairman of the Democratic Party of Virginia when he felt that he could not supprt tie Demcratic Presidtntial nominee in 1952; that Governor Tuck’s poiition involved only a matter of ethics but that Galley W. Smith’s position was alao a matter of law. Mr. Smith did not see fit to extend the courtesy of a reply to this request for his resignation. | i

Wherefore,! because the! Republican Party is absolutely entitled to representation on the Rappahannock County Electoral Board, and because a presidential election is imminnent , your orator prays that this court shall] remove the said Galley W. Smith (or some other member) forthwith and shall appoint, in his place, a properly qualifitd member of the Republican Partyj
