When asked at a subcommittee hearing what the F.C.C. had done about the reports of quiz fixing, the Chairman of that agency said it had been studying the matter but had considerable doubt it had any authority, under existing law, to do anything about it_..that any efforts to police programming might run up against the free speech guarantees of-the Omstitution.
. Another regulatory body—the Federal Trade Commission—.was brought into the committee discussion. This commission has broad authority to move against “any unfair method of competition or unfair or deceptive act of practice in commerce.” Under this law, the F.T.C. has taken steps against false or deceptive advertising in all media, including radio and television, but its concern has been for the customer who might buy and pay for a product or service so a<ivertised. The F.T.C. Chairman gave the Suscommittee his opinion that the law, as it stands now, probably would not support any proceedings by the F.T.C. against the producers or sponsors of rigged quiz programs.
