The object of this suit is to effect a partition of the real property that the Plaintiffs and Defendants, who are the heirs -at law of James W. Grigsby, Roberta Grigsby and Fannie Grigsby, jointly own in fee simple} said real estate consisting of 57-52/100 Acres more or less, located in Hampton District, Rappahannock County, Virginia, and being the same land acquired by Martin Grigsby by deed from Thomas Houghton, et ux, dated April 27,1878, as recorded in the Clerk’s Office of this Court in Deed Book “P”, page 255, and thereafter willed to the said James W. Grigsby, Roberta Grigsby and Fannie Grigsby by their father, the said Martin Grigsby, which will is recorded in 1 said office in Will Book H, page 82, and as further described in the Bill of complaint; and, if partition in kind be impracticable, that the said property be sold by the Court and the proceeds divided amongst those entitled thereo.
