Berlin called on Kuncewicz, who admitted to walking his property and seeing felled trees, some 14 to 15 inches in diameter. As evidence Kuncewicz produced a copy of the Piedmont Virginian, which included a picture of a large tree, cut down by Vepco; the paper was held to be inadmissable as evidence. When Berlin asked if Kuncewicz had visited the site where the surveying team had stopped after meeting resistance, Kuncewicz said:
“Yes, and there is the oldest grove of dogwood I have ever seen in my life — 12 inches at the base.”
NEXT BERLIN called on Henry Cook, a neighbor. He had seen trees of 8-10 inches in diameter cut by the surveying teams.
“Who did they tell you they were representing?” asked Berlin.
“They told me they were employed by the government and had a right to do it.”
So Tucker concluded that the facts before the court showed “ample evidence of a threatened and actual show of force,” and that, “to my knowledge, there has never been a refusal to grant a temporary restraining order.”
