EXTRACT from a decree of the Circuit Court of said County entered in the above entitled cause on the 14th day of November, 194$:
‘‘On consideration whereof, it appearing to the Court that said cause is properly matured for hfarinf and that said Mary Racer has a right to file her petition heroin, the Court doth adjudge, order and decree that leave be, and it is hereby granted to the said Mary Racer to file her said petition herein; and the prayer of said petition that the use of the name of the said Nat Collins aa it R*rty defendant be discos?... tinued is hereby granted.
The Court doth further adjudge, order and decree that this canse be, and it hereby is referred to James M. Settle, a Com- ( missioner in Chancery of this Court to take, state and forthwith report an account showing the following: (1) Whether all necessary parties
