Washington, Virginia, the following real estate; located at Estes, Rappahannock County, Virginia:

(1) AH that certain tract or parcel of land known as “Home Tract” containing by estimation 30 acres, lying on the East side of State Route 729, with frame house and outbuildings thereon bounded by the lands of Ralph Estes and others.

(2) All that certain tract of land lying on the West side of said State Route 729, being opposite Tract 1, containing by estimation 15 acres, and bounded by the lands of Columbus Gore and Estes.

This is the same and identical land acquired by George W. Settle from G. W. Huffman and Lizzie Mae Huffman, by deed dated February 19, 1903, and recorded July 26, 1909, in the Clerk’s Office of the Cir-, cuit Court of Rappahannock County, Virginia, in Deed Book Yy page 188, reference being hereby made to the aforesaid chancery suit being number 2232.

The real estate will be offered for sale in separate parcels and then as a whole, however, in the event a sufficient amount is realized from the sale of the tract first sold to discharge the indebtedness set forth in the Commissioner’s Report, and to pay the costs and expenses of this proceeding, the second tract of land will not be sold and both tracts will not be sold as a whole.
