Acting as council for the accused, John J. Dwyer of Huntly, presented the case as an accidental shooting which occurred when Dodson transferred a gun he had on his person from one pocket to another.
Dodson was already on probation with a suspended sentence of one year, for throwing stones at Emory Conners, husband of the shooting victim, as he drove along the highway on a tractor. He had been ordered by the court to stay away from the Conners place.
The Commonwealth attempted to prove the shooting occurred as the result of a jealous rage when Mrs. Conners spurned Dodson after a romance with him. According to testimony and evidence, a number of letters, presented, Mrs. Conners and Dodson had carried on a lengthy affair.
