Mr. Painter defied that he was intoxicated, and testified to having only one drink of gin and a bottle of beer that day. The beer was purchased at Bel Air just prior to his arrest. He also stated that his car weaving on the highway was due to a deflective light switch he was trying to fix, that his ability to walk was impaired by an old knee injury, and his jovial conduct was his normal way of acting.
The Jury was out about 30 minutes before returning a verdict of guilty.
The case was handled by George H. Davis, Jr. for the prosecution and Irwin Hackley of Luray for the defense, with Judge R. V? Snead presiding.
