The object of this suit is to effect a partition of the real property that the Plaintiffs and the defendant Dorothy Marie Settle are the co-owners of in fee simple; said real estate consisting of Tract #1 - containing 89.90 acres, and Tract #2 - containing 14 acres, located near Rock Mills, Rappahannock County, Virginia, and being the same land acquired by said parties in the partition Suit No. 2062 involving the lands of Frank (Buck) Settle, as recorded in this Clerk’s Office in Deed Book 52, at pages 23-38, and as described in the Bill of Complaint in this cause; and
Your complainants pray that partition of the real property be made by the court in this cause in one of the modes prescribed by law, and if such be impracticable that the property be sold by the court in this cause and the proceeds be divided amongst those entitled thereto, and that a reasonable attorney’s fee be allowed counsel for complainants for services rendered the parceners unrepresented by counsel.
