But the Governor, who has no direct control over SCC members since they are selected by the General Assembly, could not wait for the SCC to make up its own mind. Surely as an experienced politician and as the Chief Executive of the state he knew that his virtual endorsement of the Vepco request might well have a strong bearing on the final decision.
It is to maintain the integrity and the independence of this regulatory body that its members are not subject to gubernatorial appointment. For the Governor to intervene in advance of a judicial decision was, in my opinion, highly improper, contrary to the interests of Virginia consumers and voters whom he is supposed to represent, and totally inexcusable.
