Post-August 1953 Fathers
Selective J3ervice local boards cannot accept evidence of fatherhood presented after August 25, 1953. The Executive Order established that date as a cut-off date. The wording of the Executive Order is such that no room is left for the local board to use its own discretion or to make interpretations of it. The new rule is hard and fast. If a man presented evidence of fatherhood to his local “board before midnight of August 24, 1953, he was eligible for deferment. If the evidence was submitted tothe local board after that date, he cannot be deferred on Ithe basis of fatherhood. Extenuating circumstances and excuses canot be accepted. A man presenting the evidence after the deadline date is just too late.
Definition of Child
Under Selective Service Regulations the term "child” includes a legitimate or illegitimate child from the date of its conception, a child legally adopted, a stepchild, a foster child, and a person who is supported in good fath by the registrant in a relationship similar to that of parent and child but shall not include- any person 18— years of age or over unless he is physically or mentally handicapped._
Family Relationship
A man who submitted evidence of fatherhood to his local board before the August 25, 1953 deadline may be deferred only so long as he maintains a bona fide family relationship with the child or children in their home. In other words to qualify for a deferment, father must be living with the children in the home. If he becomes separated or divorced and is no longer living with the children, he is no longer eligible to be defered as a father and he becomes eligible for immediate reclassification.
