Miller Files Petition
For Ballot Recount
Newbiil Miller of Washington, Va., who was defeated by only one vote in the November 2nd election, has filed a suit for a recount of the ballots. Mr. Miller, incumbent for the Hampton District seat on the Rappahannock County Board of Supervisors, lost the election by one vote to Clarence Baldwin
The petition was filed Friday in Rappahannock County Circuit Court and a three judge court has been appointed to hear the case on Friday, December 17, at 10 a.m. Chief Justice of the Supreme Court of Virginia, Harold F. Snead has named Judge Carleton Penn, additional judge of the 26 th Circuit which includes Rappahannock, Fauquier and Leesburg; Judge William S. Moffett, jr. of Staunton in the 18th Circuit; and Judge Paul D. Brown of Arlington, the 35th Circuit for the hearing.
The ballots were counted only one time after the polls closed on election day, and the one vote margin was announced about 1:30 a.m.
