THERE HAD been some discussion several months earlier to change minimum lot size requirements. But the Planners decided to leave these as drafted originally.
The minimum size in an agricultural zone is two acres on 0-7% slope, and five acres on 7-14% slope. The minimum lot size in a “conservation area” is 25 acres. Lot divisions are subject to the subdivision ordinance.
Newbill Miller thought a statement was needed, explaining that two or more adjoining parcels under the same ownership can be considered as one tract for the purpose of subdivision.
Davis thought such a sentence would be superfluous. “The existing legal definition of “tract” makes adjoining parcels owned by one person one tract even if they were recorded as separate deeds,” he explained.
“I don’t think Col. McNear or a lot of people in the county read it that way, so let’s help’em out,” Newbill Miller said.
“Well, that understanding is wrong. So we still don’t need it,” George Davis sdid.
But the planners included Miller’s suggestion.
