An area labeled flood plain (and thus precluding any additional construction) can be redesignated as an agricultural or conservation zone, the planning commission decided. But first the landowner must provide historical records showing no flooding has occured on the property in 50 years as well as an engineering analysis of the property.
NEWBILL MILLER said some of the flood plain acres were labeled inaccurately. “They went by soil types, not elevation, and we should have done both.”
Miller added that he didn’t own a flood plain but thought a provision for appealing the status should be provided. A landowner will bring his case to the Board of Zoning Appeals.
