“DO WE need a public hearing?” asked Luke. McNear said it was not necessary since the request involved only lots and not an entire district. “That’s the way it is. I’ve researched this.”
“I’m afraid you’re wrong,” said Davis. “We’ve had two public hearings,” Luke said. “They weren’t advertised,” replied Davis. “Doesn’t have to be,” said McNear.
Luke again asked Davis for his opinion. “How many times do you want me to give you the same damn legal opinion?” said Davis. He expressed concern that unless the proper procedures were followed with the new erosion and sedimentation control ordinance, “someone could come in here and object and upset everything you’ve
done. It doesn’t cost any more to have you do it right.”
