Magistrates must decide if there is “probable cause" before issuing an arrest warrant. They must determine if the facts, which are contained in sworn statements given by a citizen or law enforcement officer, are reliable. The statements are given under oath in front of the magistrate.

Before a search warrant is issued, a complaint, made under oath, must be made to the magistrate by the officer seeking the search warrant. If the magistrate decides there is probable cause that a crime has been committed, then the search warrant is issued.
