The Court doth further adjudge, order and decree that this cause be, and it hereby is referred to James M. Settle, a Commissioner in Chancery of this Court to take, state and forthwith report an account showing the following: (1) Whether all necessary parties are properly before the Court in this cause. (2) The respective interests of . all parties or necessary parties in this cause in the real estate described in the bill of complaint, and whether or not said real estate is susceptible of partition in kind. (3) The fee simple apd annual rental valqe thereof. * (4) The liens and debts against said real estate and , their priorities. (5) Whether or not it would be to the best interest of all the parties to accept the offer of $1000.00 of George and Thomas Baldwin for said real estate, and whether the rights of any person would be violated if uid offer were accepted. v" (6) The cost of this suit. (7) A reasonable- attorney’s fee to be paid the attorney for the complainant for conducting this suit. (8) How said $1000.00 should be paid and distributed if the said offer is accepted.
