Meanwhile, E. A. McNear, who replaced Noce as zoning administrator, and the county, appealed. In January of 1972, the Virginia State Supreme Court overruled the earlier decision and ordered that Purcell rehear the case. The county has not yet asked Purcell for a retrial.
