EXTRACT from a decree of the Circuit Court of said County entered in the above entitled cause on the 20th day of September, 1950:
ON CONSIDERATION WHEREOF, the court doth adjudge, order and dec •*'e that this cause be and it hereby is, referred to James M. Settle, a Commissioner in Chancery of this Court, to take, state and forthwith report an account showing the following: _ (1) Whether all necessary parties are properly before the Court in this cause.
(2) What real estate was devised to the parties to this suit by W. G. Wood, deceased, and the 1 fee simple and annual value there- ‘ of. '
(3) What are the respective interests of the said parties in the said real estate and whether or not any persons other than the parties to this suit own any interest in the said real estate.
(4) The taxes due on the said real estate, the liens agairist the said real estate and their priorities.
(5) Whether or not the interest of the complainant would be promoted by a sale of the five acres, described in the bill of complaint, to George W. Wood for 3500.00 cash, and whether or not the rights of any other person would be violated thereby.
(6) Whether or not the interests of the infant remainderman would be promoted by a sale of the said property. |
(7) Whether or not the complainant has a right to have a sale ! of the five acres, to have her life j interest commuted and paid to her \ in a gross sum in cash, and to ] have the residue of the purchase \ money invested and held on the j
terms and conditions set forth in j the said will, under the provisions , of Section 8-703.1 and 8-f703JJ,of j the Code of Virginia. i
