Red Oak ’ in the above tabulation includes black, red, and scarlet oaks. “Miscellaneous” includes black gum, elm, beech, cherry, birch and maple. B. A 3-acre stand of pure Virginia Pine marked for a pulpwood cutting, consisting of 1355 trees. C. All locust on said real estate eight inches in diameter and larger, one foot above the ground will be sold and included as a part of said timber. The buyer of said timber will be required to execute a contract agreeing to use due care in cutting and removing said trees and timber so as not to injure the young timber more than is reasonably necessary; to protect the fences on the property and to properly repair any fences damaged; not to damage the roads more than is reasonably necessary and to use as nearly as possible the existing roads, trails and rights of way on said premises and to use due care not to damage any pasture or crop land in removing said timber. II. The land consisting of 478 acres and all privileges and appurtenances, buildings and improvements, except the aforesaid timber, will be sold subject to the rights of the buyer of the timber to cut and remove the same.
