A BILL introduced in the Virginia legislature by Delegate D. French Slaughter allows state agencies to accept 30 year easements, William Bolger, executive director of the Virginia Outdoors Foundation, told members of the Rappahannock League for Environmental Protection last Friday night.
Several people asked Bolger if a series of easements might prevent a new route for Vepco’s powerline, since an easement can’t be condemned by another state agency.
“Try it,” he counselled. “We can see.”
Until the Slaughter bill was passed, easements had to be granted “in perpetuity,” Bolger said. Under the new provision, an easement is reviewed at the end of 30 years. Then it can be canceled, revisedor reviewed under the original terms.
More people will be interested in an “open ended” easement like this, Bolger predicted. “Andit’s a good start. Within 30 years there will be other land use controls we never dreamed of.”
