(2) There shall be three classes of permittees, subject to the following requirements and restrictions: an apprentice class permittee shall be at least fourteen years old, shall have a sponsor who is a general or master class permittee for the first two years in which an apprentice permit is held, and may possess no more than one raptor which shall be an American kestrel, a redtailed hawk or a red-shouldered hawk. A general class permittee shall be at least eighteen years old, shall have at least two years of experience in the practice of falconry, may not possess more than two raptors, and may not ' take, transport or possess any golden eagle or any species listed as endangered or threatened pursuant to the federal Endangered Species Act of 1973. A master class permittee shall have at least five years of experience in the practice of falconry at the general class level; may not take, transport or possess any golden eagle or any species listed as endangered pursuant to the federal Endangered Species Act of 1973 unless authorized in writing to do so; and may not take, transport or possess more than one of any species listed as threatened pursuant to the federal Endangered Species Act of 1973 unless authorized in writing to do so.
(3) An inventory report of raptors held in captivity shall be made by their owners within ninety days of the effective date of this regulation, and no raptor may be lawfully acquired after such report is submitted unless the owner first obtains an authorized marker and attaches it to the raptor immediately upon acquisition. It shall be unlawful to alter, counterfeit or deface an authorized raptor marker.
(4) Young raptors not capable of flight may be captured from the wild by a general master falconer from May 1 to June 30 of each year, but not more than two may be taken by the same permittee during any calendar year. There also shall be an open season for capturing firstyear birds for falconry purposes from August 3 through November 30 of each year. Only American kestrels and greathorned owls may be taken under a falconry permit when over one year old.
(5) Raptors lawfully acquired before the enactLment of these regulations, by persons who subsequently fail to meet permit requirements, may be retained if identified with authorized markers, but may not be replaced in case of their death, loss, release or escape. Raptors lawfully in possession before enactment of these regulations, in excess of those allowed under the owner’s class permit, may be similarly marked and retained, but not replaced imtil the number in possession is less than the number allowed under the owner’s permit.
(6) Species not indigenous to Virginia shall not be intentionally released to the wild without written authorization, and the marker from any intentionally released bird shall be removed and surrendered to the Commission, and a standard federal bird band shall be attached to such bird by an authorized bird bander.
