June Jordan asked if the ordinance could be written so that it applied only to problem-causing dogs while allowing well-behaved animals their freedom.
One Bite State
“Virginia is a one bite state," said Washington attorney Peter Luke in explaining legalities involved with a leash ordinance. "The dog gets one free bite...That puts the owner on notice that the dog is vicious. Then the owner may be found negligent if the dog bites a second time,” he explained. "But if you have a leash law and a person is bitten by a dog running loose, the person bitten has easier legal recourse.”
As for enacting a dog nuisance law that will require only problem dogs to be leashed. Luke said he didn’t know if this would be allowed under state enabling legislation.
Councilman C. E. Giles suggested that state enabling legislation be researched to determine what type of ordinance the town can enact with the proposed law to be voted on at the September council meeting. His motion passed unanimously.
