RLEP had tried a petition campaign. Irwin said they hadn’t. “We had public hearings. One hundred and fifty-three people spoke again-" st the powerline, no one was in favor. We felt this was far more effective than a petition .campaign.”
Irwin reminded his listeners that the Supreme Court will only review testimony and evidence that was submitted at the lower court level. No new evidence can be submitted.
Ed Harris was worried that Vepco is now in a position to proceed with construction of the powerline, since the SCC has approved their request. Harris said he understood that RLEP would have to file an appeal bond if they wanted to prevent Vepco from beginning work. But, Harris said, the bond requirement is waived if a local government files to block construction until after the appeal.
