WHEREAS, the governing body of Rappahannock County, Virginia deems it appropriate to assess a penalty of 10 percentum on taxes owned for failure to file a return with respect to personal property tax. which penalty shall consist of 10% of the tax assessable on such tax return or a $5.00 minimum, which penalty shall be assessed on the day after such return or application is due; provided, however, that such penalty and interest for failure to file a return shall be waived where a showing is made by the taxpayer that the failure to file such return was not in any way the fault of the taxpayer
NOW, THEREFORE, BE IT ORDAINED, that a penalty of 10 percentum of the total personal property tax due shall be assessed by the Commissioner of Revenue of Rappahannock County on all unpaid personal property taxes due where the personal property tax return is not filed with the Commissioner of Revenue for the County of Rappahannock on or before May 1, of any year, provided, however, that the Commissioner of Revenue shall waive such penalty where a delinquent taxpayer shows that failure to file a return was not in any way the fault of the taxpayer
