Russell’s building, formerly Texas Pete’s Bar-BeeQue was totally destroyed by fire in August, 1975. Questioning the variance on the three year time limit for rebuilding, Pete Estes noted he wasn’t opposing Russell’s request but pointed out that the time limit couldn't be a factor since the structure suffered more than 50 per cent damage. “He couldn’t have rebuilt even if he was within the three year limit,” said Estes, maintaining that if the BZA wanted to grant a variance, it would have to find another section of the ordinance under which to authorize Russell’s request.
The rest of the board ignored Estes’ argument and went on to move that the variance to the three year time limit be granted, extending Russell’s right to rebuild for another three years. Estes voted with the other BZA members to unanimously grant the variance.
No mention was made of the lot's designation as flood plain even though Article 9 of the zoning ordinance speciafically forbids assuing a permit for any building, structure or sewage disposal system within 50 feet of a flood plain. The same section also states that no building, structure or sewage disposal system shall be located on a flood plain.
