Replying to Baumgardner’s opinion in a letter dated December 5, Rev. Savage maintained that Massanova Pentecostal Church is a nonconforming use since it existed prior to the adoption of the zoning ordinance in 1973 and therefore is permitted to conduct its school ministry, a function that the pastor has described as an intergal part of the church.
In his December 23 letter to Savage, Konick pointed out that the continuation of a non-conforming use is limited to any legal activity which was being pursued at the time of the enactment of the ordinance in 1973.
‘:To the best of my knowledge, at the time the 1973 ordinance was enacted, the Massanova Pentecostal Church was used solely for religious services and Sunday School on a weekly basis. The first use of the premises as a school on a daily basis began in August. 1981,” Konick noted.
