EXTRACT from a decree of the Circuit Court of said County entered in the above entitled cause on the 10th day of March, 1952:

Upon consideration whereof the Court does hereby order, adjudge and decree that thjs cause be and the same hereby is referred to Jas. M. Settle, Master Commissioner in Chancery of this Court with direction to take, state and forthwith report an account showing the following:

1. Whether or not the real estate described in the bill of complaint in this cause is susceptible of partition in kind among the owners thereof.

2. Whether or not all the owners of said real estate or parties who might have an interest therein are properly before the Court and whether or not they are all sui juris.

3. The fee simple and annual rental value of said real estate. 4. The taxes due, and the liens on said real estate, if any, and their priorities. . 5. Whether or not it would be to' the advantage of the owners of said real estate to have a sale of said ...real estate, and if so, how said - sale should be made. 6- Whether the rights of any person would be violated by a sale thereof. 7. The respective interests of the parties to this cause in said real estate.

8. What would be a fair compensation to be allowed Counsel for complainant for instituting and conducting this cause. 9. Any matter which may be deemed pertinent by the Commissioner or required to be stated by any party in interest.

The said Commissioner shall give notice of the time and place of the execution of this order by publication thereof once a week for two successive weeks in the Rappahannock News, a newspaper having general circulation in Rappahannock County, Virginia, which publication shall be equivalent to (personal notice to all parties in interest.
