Savage, Jr., who was named attorney for the estate. The will had specified that Laney G. Payne, business associate of Pitts’, serve as trustee and executor with his son-in-law and Savage. Payne, however, died in January of last year. In other bequests, Carolinous L. Pitts, a brother, was given a $25,000 lump sum, plus $5,000 a year, and J. Thomas Pitts, a nephew, was given $25,000. Miss Frieda B. Pollard, secretary, was bequeathed $10,* 000 for 10 years and $5,000 annually thereafter. She also was to retain her position fol: life. Her .salary, as .of 1957*. was to be continued and she was to remain on the payroll in case of disability. T. I. Martin of Culpeper, who manages Pitts Theater there and also Pitts-Madison here was left $10,000. The Benjamin T. Pitts Foundation, which annually distributes college scholarships to deserving high school seniors in the area, was given $300,000 which "need not necessarily be paid in money" to be used by the trustees “for objects and purposes" in its charter. The Fredericksburg First Baptist Church was bequeathed $25,000 and the First Christian Church, $5,000. Mary Washington Hospital was recipient of $20,000 and Fred ericksburg Lodge No. 875, Benevolent and Protective Order of the Elks, $15,000to be used to help needy members and families. In addition to Carolinous Pitts, two other brothers, Joseph L. and John D. Pitts; three sisters, Sarah E. Grady Martha Carneal and Mary Jane O’Donnell, and 11 other relatives were to receive $5,000 annually. Payne, now deceased, had been willed a lump sum of $25,000 plus $5,000 a year. In a codicil, entered on the same date as the will, Pitts noted that•the trustees continue to operate the motion picture and candy business for at least 15 years.

The annual bequests are to come from a trust fund, which ultimately is to be divided among the heirs then living. The will provides for termination of the trust fund upon the death of the last of the children of Norma Pitts Lowry, Sara L. Grady, Martha Carneal, Mary Jane O’Donnell, John D. Pitts, and Joseph L. Pitts.
