secondary, collegiate, graduate or other education or training of emotionally disturbed, mentally retarded, and mentally or physically handicapped Virginia students, and such other handicapped Virginia students as may be prescribed by law, in schools and institutions of learning in addition to those owned or exclusively controlled by the Commonwealth or any such local governmental unit. ..”
A careful reading of this resolution reveals these points:
1. The State may tax all citizens to support the education of handicapped students in sectarian schools.
2. Sectarian schools, even theological seminaries, may receive tax funds to train handicapped students.
3. The word “handicapped” may include not only physically or mentally, but is subject to wider interpretation such as socially or economically. 4. There is nothing in the resolution that defines the extent of disability. 5 The State already provides aid to handicapped students through the public school system and State owned institutions. 6 It discriminates against Virginia students in privately owned institutions who are not handicapped. 7.
