General state rules prohibiting open burning remain in force at all hours, all year long, wherever these bans apply.—The special forestry requirements currently imposed for the spring season apply only to areas where burning is legal at other times, state air pollution control officers point out. In other words, the forestry rules which allow some burning from 4 p.m. to midnight still do not permit—even during those hours— any burning whatever that is banned by other rules, the State Air Pollution Control Board staffers emphasize.
The State Forestry Law provision applies only to burning within 300 feet of woodlands or brushland. From March 1 to May 15 annually, that law forbids any such burning except from 4p.m. to midnight. But state air board rules may well prohibit such burning at any time. The board rules for example ban all open burning of household refuse where collection service is provided at least once a week or where the locality provides collection boxes. The rules ban all leaf burning where there is leaf collection service, unless a local ordinance specifically allows leaf burning.
