The overwhelming part of the evidence presented at the hearing was against having a landfill at the Sperryville location, said Baumgardner, and no one other than the applicant appeared in favor of the request. The BZA ruling “put the problem back in the hands of the Supervisors for resolution.”
“The trash is the Updike’s property,” said Planning Commission Chairman H.S. Barksdale.“It’s up to them to get busy and find a place to put it.”
Luke replied that the Updikes were already looking and that he had given them the names of two or three people suggested by Supervisor Clarence Baldwin, who might have suitable property available for lease. But, said Luke, a special use permit would still be necessary, even for leased property. He maintained that the same objections raised by neighboring property owners at the BZA hearing, of possible water contamination, would be given, the same petitions against the request would be presented, and the BZA would again deny the special use permit request.
