“I HAVE recommended this in particular, and I even tried to explain this to a previous Game Warden,” George Davis said. As to the part of the News editorial which questioned why Davis didn’t advise the Supervisors of their right to adopt an emergency ordinance which would have applied to the current hunting season, Davis insisted that he could not “legally advise then that there was a legal emergency, calling for special action.”
“An emergency has to be stated in the body of the act,” he said, “and it has to be exactly what it says—an emergency. I would feel I would have been subjected to ridicule by other members of the bar and the court if I had tried to prosecute such an ordinance as an emergency.”—Ray Dilley □
