Mr. Town, who lives three blocks from the site of the proposed building, told the commissioners that a covenant on the original deed states that no building shall be erected on the subdivision lots except for single family dwellings and private garages. “Does this commission have the legal authority to void a covenant?”
Since two lots are normally required to provide enough land for a well and drainfield to serve a single family residence, this proposal effectively doubles the standard density, Mr. Town continued. If the remaining 300 unimproved lots in the subdivision are developed in a similar manner, the private wells drilled for the apartment units “would surely depress the water table,” he cautioned.
In addition, he said, the traffic generated by similar apartment development would worsen already poor private roads which are maintained by voluntary contributions from subdivision residents.
