That was the question at the Rappahannock County Board of Supervisors’ meeting last month. The answer then, for Grimsley Road, Route 638 near Flint Hill, was to pave, at least some of the road. It’s still the answer, but not everybody is satisfied. At that meeting most residents spoke against paving Grimsley Road. It looked like a one-sided decision, with all but one person wanting to leave the road as is. Pete' Estes Piedmont supervisor Shooting is first homicide in years By Mary Ann Kuhn , Rappahannock Newn Staff Writer A shooting death in Huntly this week broke rural Rappahannock County's nearly five-year-streak of peace and quiet on the homicide front. Joel Racine Marshall, 58, of 2072 Zachary Taylor Highway, Huntly, has been charged with first degree murder in the shooting death of Roy Lee Frazier, 45, of Castleton, officials said. Frazier was a work hand for many in the county. The offense allegedly occurred on Sunday, Dec. 14 at Marshall s home which is located on the right side of Route 522, driving up towards Chester Gap. He was apprehended there the next day. There are others who are simply unable to afford it. It's in situations like these that the Rappahannock County Department of Social Services, with the community’s help, finds a way to Meetings & Notices • The Rappahannock News will have an early deadline for next week's paper due to the Christmas holiday. All items for publication in the Thursday, Dec. 25 edition should be submitted no later than Friday, Dec. 19. • The Town of Washington’s Christmas party has been rescheduled for Sunday, Dec. 21 at 5 p.m. at the Town Hall on Gay Street. • On Monday, Dec. 22 the Town of Washington’s Planning Commission will hold a meeting at 7:30 p.m. at the Town Hail on Gay Street. • Rappahannock County government offices will dose at 12 noon on Wednesday, Dec. 24 and reopen Monday, Dec. 29. • On Wednesday, Dec. 24 the Rappahannock National Bank will dose at 12 noon and reopen with regular hours on Friday, Dec. 26. • Rappahannock County pubfic schools will be closed for students from Monday, Dec. 22 through Friday, Jan. 2. This season, the public has contributed a variety of foods and about $700 in monetary donations to benefit the county’s less fortunate citizens during Christmas, said Marie Davis, office manager at the local Social Services department. “There are always families who come in and have nothing for their children and we try to have some funds available for people to give gifts,” said Davis. “We try to, I guess, play Santa Claus for the have-nots.” The agency also operates an adopt-a-family program. Rappahannock News Pholo/Leslie Menelee Loudoun has nation’s first ‘spam’ cases By Jon Echtenkamp Rappahannock New* Staff Writer A Loudoun County grand jury has returned the nation’s first indictments dealing with the criminal distribution of illegal, bulk e-mails, or “spam,” Virginia Attorney General Jerry Kilgore announced last Thursday. Kilgore also announced that one of the indicted men, who is considered the eighth worst spam distributor in the world, was arrested Thursday morning in North Carolina and will be extradited here to stand trial. The arrest marks the first time someone has been arrested in the United States for the criminal distribution of spam. The indictments and arrest follow the General Assembly’s passage earlier this year of an anti-spam law, which was authored by Kilgore <R). The law is considered the toughest in the country and formed the model for the federal anti-spam law, Kilgore’s office said in a statement. The Dec. 8 indictments and arrest are milestones in government officials’ efforts to police the Internet — once commonly referred to as the “information superhighway”— in deference to the critical role it plays in the new economy. “Anyone who has e-mail certainly knows about spam — that frustrating, unwanted e-mail that shows up every day by the dozens or hundreds in your in-box,” Kilgore said. “Spam has a direct, negative impact on the efficiency and effectiveness of the free enterprise system and day-today operations of business.” Kilgore made the announcement at America Online headquarters in Dulles, along with officials from AOL, MCI and UUNet. The state law makes spam criminal in Virginia if any part of the spam transactions occur in any Virginia locality. Newlin, General Registrar of Rappahannock County, has been awarded the title, Certified Professional General Registrar, under the Master Designation program administered by the University of Virginia’s Weldon Cooper Center for Public Service and the School of Continuing and Professional Studies. The designation programs were developed to enhance the professionalism of local government officials and their staff. The program, which takes a minimum of three years to complete, requires a combination of extensive education and governmental experience. A certificate is presented for successful completion of the program. The education process does not, however, end with the completion of the program. Virginia’s governor and lieutenant governor visit here Virginia’s top officials came to our town recently for social visits. Virginia Gov. Mark Warner celebrated his birthday at a dinner party at the Inn at Little Washington last Friday evening. Two weeks earlier, Lt. Gov. Mayor: ‘I don’t think there’s a real reason for fear’ on town liability By Leslie Menekee Rappahannock Nows Staff Writer The Washington Town Council meeting last Wednesday included a discussion on the town’s financial liability, specifically concerning the state’s possible repeal of the Meals and Lodging Tax which would significantly impact the town’s ability to pay its bills. During the public forum at the end of the meeting Washington resident Bill Tieckelmann asked the council what costs residents would incur if the town was unable to pay any of its bills, especially through the loss of assets if the Meals and Lodging Tax is repealed. Seventy to 80 percent of the town’s income comes from the meals and lodging tax collected by the Inn at Little Washington. That number goes even higher when the tax money from the town’s four bed and breakfasts is included. While Tieckelmann didn’t specify the lawsuit facing the town, which was filed by Sid and Mary Catherine Worley, he has made reference to it in previous meetings seeking to find out the town’s liability. The Worleys are seeking $995,382.95 in damages after they were denied permission to build a single-family home on Main Street. “What I'm asking is,” Tieckelmann said, “if for some reason the town conceded its ability to pay its bills. . . what are our options for paying those bills and recovering that money?” Mayor Eugene Leggett, who along with the council is under orders from the town’s attorney not to discuss the Worley case, responded in general terms. “There are many sources of liability in the town, including spending more than what we are making, sudden decrease in income, insurance, and so forth,” he said. Leggett added that previous town councils had done a good job husbanding the resources, building up reserves and had met all their obligations. The mayor said that the town couldn't describe the outcome of a situation that has not occurred. “It’s just not a question we have to deal with until it happens,” Leggett said. "All we can do is conserve our money, keep our credit good and proceed with a gradual improvement.” If such an incident were to occur, Leggett said, alternatives would include borrowing money, increasing revenue, or in the worst case declaring bankruptcy. He added that the town has a good credit rating, making loans a good possibility. “I don’t think there’s a real reason for fear to citizens of the town,” Leggett said. “There is no imminent threat. He said the council will need to review the bids and make a decision. Benson said he expects the town will have selected an engineer by January or February. In other action, council members voted unanimously to allow high school students to begin repairing the town’s street signs in January. According to council member Claudia Mitchell the signs will cost $50 each, which includes materials and labor. “We are very excited to keep the money in the neighborhood,” she said. While there were no protests at the North Carolina event, the first day at the Air and Space annex was marred by protesters. A small but vocal group slipped into the museum and positioned themselves around the Enola Gay, the B-29 bomber from which an atomic bomb was dropped on Hiroshima, Japan, and chanted anti-war slogans. One man smashed a container filled with red liquid — presumably meant to look like blood — on the side of the airplane, denting the fuselage. While this newspaper would never discourage peaceful protest by sincere citizens, the ineffective way they went about making their point is matched only by their ignorance of history. x No one can imagine the horror when the atomic bomb exploded on Hiroshima. But the loss of life there, and later at Nagasaki, was only a small fraction of the death and destruction that would have resulted, had Allied forces invaded Japan. Those charged with strategic planning of the invasion figured that there would be at least 1,000,000 allied casualties, and perhaps as many as three million Japanese killed or wounded during ah invasion of the home islands. At least three fleet aircraft carriers would be lost — probably to Kamikaze attacks, as well as large percentages of Army and Marine Corps regiments. "That the Japanese decided to surrender when they did saved millions of lives. It is a little known fact that President Truman had at his disposal nine more atomic bombs, which would have been dropped on Japan in a “Rain of Ruin.” Instead of the mass carnage that could have been, many lives were spared, the post-war occupation was short, and the U. S. and Japan later became allies. Wasn’t that better than sacrificing a large part of a generation of Americans and more innocent Japanese? Letters ‘It is grossly unfair to belittle Frances Foster for doing her job’ Ire-read my tax bill with a renewed interest after reading “A taxing time at the tax office” letter to the editor in the Dec. 11 edition of the Rappahannock News. It clearly states on both the real estate and personal property bills that a 10 percent penalty will be assessed if the bills are not paid by Dec. 5. There is no mention of “weather permitting.” Edmund Kavanagh paid his bills on Dec. 8. He should be assessed the penalty, period. It is grossly unfair to belittle Frances Foster for doing her job. What does running unopposed for office and the rules and regulations of the state Tax Code have in common? She does not make these rules up “on the fly” nor does she penalize one and not the other. Our tax bills are mailed at least six weeks before they are due as a courtesy on the part of our treasurer. The code section states only that the tax bills be mailed “not later than 14 days” prior to when they are due. This does not sound like a “pompous mantle of royalty” to me. The statement that Mrs. Foster “lives only around the comer” is true. However, the other three employees of the office do not. All made it in safely and on time. Let it also be known that Mr. Kavanagh owns a business in the town of Washington, just around the comer from the tax office. There should have been ample time in those six weeks for Mr. Kavanagh to take those “few steps” himself. Mr. Kavanagh chose to take the chance and wait until the last day to pay his taxes. He has no one to blame but himself for the extra $261.84 it cost him. Wayne Sumner Boston ‘Everyone is responsible for their own mistakes’ I was surprised to see Edmund Kavanagh’s letter in the Dec. 11 issue of the Rappahannock News. I regret that Mr. Kavanagh had a problem, however, everyone is responsible for their own mistakes. I missed a payment one time on my county fees/taxes and had to pay a penalty I did not like it, but I understood that it was nobody’s fault except my own. It is regrettable that Mr. Kavanagh is blaming others for his lack of planning. Frances Foster is a lady of impeccable charm and honesty. In my 50 years of knowing her, she has always been kind and considerate. It is my under standing she is required by law to assess a penalty on any taxes not paid by Dec. 5. She has no latitude in waiving the penalty. James W. Fletcher, HI Sperryville Complaint ‘struck an unfair blow’ against Frances Foster’ The complaint of Edmund Kavanagh that was published in last week’s Rappahannock News struck an unfair blow against one of the finest and most dedicated public servants Rappahannock County has ever had. In my experience, Frances Foster is considerate and courteous to all local taxpayers, even those who sometimes, as in this case, do not appreciate or reciprocate her kindness. As a Constitutional Officer, she collects local taxes according to state law (Virginia Code 58.1-3916) and local ordinance, and not on the basis of favoritism or according to her own personal whims of fancy. The law provides that if real estate taxes are not paid by the Dec. 5 deadline, there is a penalty. This has been printed in big bold print on every tax bill issued since John Smith married Pocahontas. Nothing precluded Mr. Kavanagh from paying his real estate taxes a day, a week or a month before the actual deadline, especially when he, like every other responsible person in the county, heard that we were in for a substantial amount of snow on Friday, Dec. 5. If Mr. Kavanagh is dissatisfied that he was required to pay the penalty, he has no one but himself to blame for it. Why didn’t he just come in and pay his taxes on Thursday, or drop a check in the mail? And why the Rappahannock News saw fit even to publish such a letter so utterly lacking in any basis in fact or reality I also have no clue. Instead of casting aspersions on the county treasurer, Mr. Kavanagh and anyone else who thinks he has a legitimate basis for complaint would do well to recall the words of Theodore Roosevelt, first spoken on Dec. 7,1903, exactly a century and two days before Mr. Kavanagh missed the real estate payment deadline: “No man is above the law and no man is below it; nor do we ask any man’s permission when we require him to obey it .... Obedience to the law is demanded as a right; not asked as a favor.” Mr. Kavanagh owes Frances Foster a public apology and so does the Rappahannock News. Shame on them. David L. Konick Rock Mills ‘Jamie’ Jamieson contributed much to the county I?d like to add a little to James ‘Jamie’ Jamieson’s obituary published in last week’s Rappahannock News. Jamie contributed much to Rappahannock County, sharing his financial expertise with the Rappahannock Hunt, then in 1974 helping to establish “Friends of the Library” and serving as its chairman. “Friends” is dedicated to helping Rappahannock County Library in all ways and in particular provides financial assistance. The efforts of Jamie and his wife, Mary, helped tremendously in building our “new” library, and the public meeting room is named in their honor. The Jamiesons were declared 1984 Citizens of the Year by the Rappahannock News which noted that “Mr. Jamieson volunteered, helping the WSA (Water and Sewer Authority) secure bond financing that ensured construction of a waste treatment plant for Sperryville." Grace Sims Washington The ‘wealth’ of Rappahannock County’s public schools Paul Gall’s conclusion that Rappahannock County is the 10th wealthiest school district in Virginia, in his otherwise excellent article on tracks in the Rappahannock News Dec. 4 was in error. The Composite Index of Local Ability to Pay (often called the Local Composite Index or “LCr>, on which Mr. Gall based his conclusion, is not adjusted for revenue deferred under our Land Use Value program. Rappahannock County’s participation in the Land Use Value program has been spectacularly successful in keeping the county scenic, but has had the unintended side-effect of distorting the Commonwealth’s evaluation of Rappahannock’s ability to fund public education. The Commonwealth judges the wealth of our public schools based on the market value of all Rappahannock County real estate, not tire taxable value. For good or for ill, Rappahannock County relinquishes over 50 percent of its potential tax revenue through the Land Use program. Furthermore, the state contribution is much lower than it would be if the LCI were based on taxable value. Only one other county in the state, Rockbridge (like us, very progressive in its commitment to the preservation of open space), is in a similar situation. Viewing legislative efforts to “correct” the LCI as almost certainly doomed to failure, and armed with the argument that Rappahannock’s policies further the state goal of preserving open space, the Alternative Funding Committee appointed by the Board of Supervisors (of which I was a member) recommended in its final report that the county seek an “appropriations-based remedy” by the Commonwealth for the LCI's skewing effect on state aid for education. Members of the committee are pursing this possibility. Other potential solutions include the efforts of RCCA and other organizations to increase the amount of land under conservation easement (which would have a corrective effect on the LCI). In the meantime, I am convinced that solutions to the challenge of funding a track and field project are within reach. A partnership including the public schools, Headwaters, and the Parks & Recreation Authority will this month sub mit a proposal to the Nike Bowerman Track Renovation Program, a program providing up to $50,000 in matching hinds to community-based, youth-oriented organizations seeking to refurbish or construct running tracks. As voted by the supervisors, 0.3 miles of the road will be paved as part of the Virginia Department of Transportation’s (VDOT) Rural Rustic Road program. Under this program,, selected secondary roads are given a tar and chip surface but are not widened. Roads may receive drainage improvements before paving. The project was made a part of VDOT’s six-year plan, which means it may take several years before paving actually takes place. Grimsley Road is partly paved now, including a steep and curvy section at the eastern end at the intersection with Route 729. The plan approved by the supervisors would pave an additional 0.3 mile ending at Harry and Homicide From Page A1 filed in General District Court by Major Chris Williams of the Rappahannock County Sheriff s Office, Marshall and Frazier "had a heated argument" on Sunday, Dec. 14 at about 12 a.m. "During the argument Joel Marshall pulled a .25 caliber pistol and shot Roy in the head killing Roy," Williams stated in the complaint. In addition to the first degree murder charge, Marshall is also charged with use of a firearm in the commission of a murder and possession of a firearm by a convicted felon. Officials said Frazier, the victim, was visiting Marshall at the time of the shooting. The Sheriffs Office was notified of the shooting after "an individual stopped by Mr. Marshall's house, discovered the body and called the Sheriff s Office. This individual has nothing to do with it," said Commonwealth's Attorney Peter Luke. At his first court appearance Tuesday morning before General District Court Judge Charles Foley, Marshall was denied bail. However, the judge will consider a bail motion on Jan. 6. A preliminary hearing is set for Feb. 3. At the hearing, Marshall said he is on a VA disability and indicated he is not employed. Luke said it appeared "the deceased died from a single gunshot wound to his head." After the hearing, Luke was reluctant to discuss the facts of the case or motive because he didn't want "to taint the jury pool" selected for a trial. "It’s a small county, word spreads fast," he said. Marshall, who has one prior felony conviction, is currently in the Rappahannock County jail awaiting his Jan. 6 court date, officials said. His birthday is today. Meanwhile, Marshall's dog has been taken by the Sheriffs Office to the county animal shelter, according to Luke, and Marshall has been asked if he would allow the dog to be adopted. They are awaiting an answer. The last homicide in the county was March, 3, 1999 when an apparent dispute over money resulted in the shooting death of Willie Steve Nichols Jr., 28, of Boston at a home near Scrabble. Joseph C. Johnson, then 41, was charged and convicted of murder The homicide before this 1999 one occurred 12 years earlier and involved a "domestic situation" in F. T. Valley, said Luke. Nancy Newlin’s residence. Harry Newlin was the only resident who spoke in favor of paving at the November meeting. His opinion and that of the many residents opposed to paving have been widely reported in both the Rappahannock News and over the Internet on Rapplinks. What made the supervisors vote as they did on this issue? Grimsley Road lies partly in the Wakefield District served by supervisor Roger Welch and partly in the Jackson District served by supervisor Ronald Frazier. Welch voted against paving; Frazier voted to pave. Welch said that prior to the meeting he talked with several residents and nearly all were against paving. “I voted against it. I thought the funds could be better used." he said. “But it passed anyway. That’s democracy in action." It was “a compromise” to pave threetenths of a mile, he added. Frazier said he voted to pave because the road is “already partially paved. It's a public through road, not a dead end.” As did several other supervisors, he expressed concern about school buses. “Suppose Route 647 gets flooded? Grimsley Road is a better alternative than 637 (North Poes Road1).” Frazier also expressed doubt that the road would, in fact, be paved within the six-year plan. “It may take several years longer.” Piedmont supervisor and chair Charles K. “Pete” Estes voted to pave. “All roads are public roads. Look to the future. (Grimsley Road) is prime real estate and it will be developed," he said. “We may have to send $50,000 school buses down that road. VDOT recommended paving. After initial costs, a paved road is easier to maintain and plow.” Estes added that some Grimslev Road residents have changed their minds about paving. He’s had several phone calls. “A few years ago residents—who are now against paving—were asking for the road to be paved.” Bryant Lee, supervisor of the adjacent Hampton District, voted to pave. “It’s useful for the county as a whole. VDOT currently spends $8,000 to 12,000 a year to maintain the road as it is. Tar and chip will take much less maintenance,” he explained. “It had nothing to do with Newlin,” he added. “Traffic won’t increase (after paving) because the road is not a short cut.” And, like Estes. However, people would end up with food they couldn’t use because of certain ingredients such as salt or sugar. That’s when the agency decided to offer the gift certificates. She added that the agency has received more applications this year than previous years. “Basically I guess we just need to let people know that there are people here in the county who need assistance at some time,” Davis said. “I don’t know if there are a lot of needy families (in Rappahannock) but there are a lot of families who have a need at some time. I think the economy may have something to do with that,” said Davis. “The applicants are not always needy but they have emergencies and they can’t meet that emergency need,” Davis said, such as an unpaid electric or gas bill. The agency can’t pay the entire bill but they will try to match the same amount gathered by the applicant. Those seeking aid can complete an application provided by the agency, which explains the nine programs offered. Davis said she believes part of the problem is that some people don’t understand how to properly budget their money. “I guess they haven’t been taught to budget.” The agency tries to do just that. Sometimes it refers people to Virginia Cooperative Extension, which offers a seminar on money management. Getting involved Regardless of the season, the agency welcomes donations from the public to benefit people year-round. It also operates a food closet throughout the year. “We take money donations year-round because people always have emergencies,” Davis said. Benefactors also have an option when donating, whether it’s to help someone pay their electric bill or provide food to needy residents. Spam From Page A1 obtained a search warrant and arrested Jeremy Jaynes Thursday morning and charged him with four felony counts of using fraudulent means to transmit unsolicited, bulk e-mail in violation of the Virginia’s anti-spam law, Kilgore said. Each felony count carries a punishment of one to five years in prison and a fine of up to $2,500, or both. Jaynes also goes by the aliases Jeremy James or Gaven Stubberfield, Kilgore said. The Register of Known Spam Operations lists Stubberfield as the eighth-most prolific spammer on its Web site www.spamhaus.com, according to Kilgore. The indictment alleges Jaynes sent spam that exceeded 10,000 emails per day on three separate days in July, and that he sent more than 100,000 e-mails during a 30-day period in July and August, Kilgore said. The state law makes it a felony to send unsolicited, bulk e-mail by fraudulent means such as removing the sender information, thus preventing recipients from replying or knowing who o^nt flip A-mail TKp anom is illegal if the volume exceeds 10,000 e-mails in 24 hours or 100,000 in 30 days, or if the revenue from the spam exceeds $1,000 or if the total revenue from the spam transmitted to any Internet service provider exceeds $50,000. December 18, 2003 ‘The Three RV exhibit! ‘unusual works by artists9 T3 V T~\t A a Dinn Special to the Rappahannock News “The Three R’s” exhibit currently on view at the Packing Shed Gallery in Washington accomplishes several things, most notable of which is an opportunity to see at one time a group of unusual works by artists who are clearly not in competition with one another. In addition, we can see for the first time in years Rex Slack’s works that renew our knowledge of this thoughtful and skilled worker. No matter what Slack turns his hand to, he produces something moving and beautiful. There are several of his nostalgic, miniature constructions of mobile homes and a country store. Each detail of the living arrangements of people who must settle for a mobile home reminds us of the choices poor people resort to and how important “home” is. The discriminating care brought to bear here shows us how to delight. Slack’s other work, drawing, paintings and more, arouses feelings that come from diverse directions, all reflective of a person of both humorous and profound emotions. Rene Ruffner’s concentration on scenes in pool halls takes us to a world only some of us have experienced but all of us unconsciously integrate into our understanding of our nation and its interests. Beginning at the turn of the century, George Bellows, Edward Hopper and many others, including “documentary photographers” turned their attention to the more or less everyday American scene, often with ironic or satiric purposes. The serenity of expression on the man's face suggests how satisfying participating in a competitive game of skill can be. Ruffner includes in his paintings enough of the pool hall settings and the players’ Figures to bring the viewer fully into the world portrayed. These pictures reveal a facet of Ruffner’s personality new to those of us used to seeing his interest in fantasy and renaissance colors and techniques. Most of Robin Purnell’s 14 pictures are of people and scenes she encountered while living in Kazakhstan, although several bril liant ones are of current or former Rappahannock inhabitants. Kazakh natives are for the most part, not surprisingly, oriental, with the fascination for us that foreign looks .can occasion. As a portraitist, Purnell delights in showing the variety that is found in individuals different from ourselves, examples of their society. Years ago her pictures brought back from St. Petersburg sometimes portrayed lives stunted by communism, but these from Kazakhstan reflect the world they inhabit even though the Soviets worked to replace the idiosyncratic Kazakh culture with a Russian dominated one. The bright colors of the costumes that appear in some of the pictures and the apples, squash and other details remind us that Kazakhstan is still an agricultural world where we think of people as natives. (Some of us here like to think of ourselves as natives too!) Purnell enjoyed the exotic, ... Rappahannock Democrats reorganize at biennial caucus By Bruce Sloane Special to the Rappahannock News Floyd Stilley was elected chair of the Rappahannock County Democratic Committee for the next two years at the party’s biennial reorganization caucus last Saturday morning. He succeeds Meredith Gorfein who has headed the committee for the past four years. Stilley was secretary of the committee during Gorfein’s administration. Linda Dietel was elected vicechair, replacing Fran Krebser. Other officers elected were Julie Emery, secretary; and Yogi Bear, treasurer, to succeed Andrew Platt. After the election, Gorfein received a unanimous ovation and vote of thanks for her leadership and accomplishments as chair. In his acceptance speech, Stilley lamented the fact that President George W. Bush has polarized the country, and he emphasized the need to elect a president who can bring the country back together. In addition, he told the group that voting districts should be geographically contiguous and not gerryman dered for political reasons. He also said that it was important to field Democratic candidates in as many races as possible and praised the local committee for helping Tom Lewis run as a Democratic candidate for the House of Delegates in the 15th District, which includes Rappahannock County. The local reorganization caucus is mandated every two years by the state Democratic committee. Before the meeting in the Washington Town Hall the 40 participants socialized as they consumed a plentiful buffet breakfast prepared by members of the caucus. Stilley reminded the group that the committee meets the first Tuesday of every month at 7:30 p.m. at the Rappahannock County Library. At the next meeting on Jan. 6 work groups and subcommittees will be established. All are welcome, whether or not they attended the caucus. On weekends, Fred Wilson, John Wallace and James Helmic put away their chain saws and the big wood chipper and pick up their instruments to sound out some of the best country music around. In the same way, lead guitar Terry Pace puts aside his plumber’s tools to pick up the beat as “Southern Action’ does such favorites as “Mustang Sally” and “Shaky Ground.” The four, plus vocalist Jennifer Collins, will be on stage Saturday night, Dec. 20, for a dance at the Amissville Volunteer Fire and Rescue Company. “Southern Action” is the band known for packing the house at Rex’s in Culpeper as well as Moose Lodges in Culppper and Warrenton, and Jerry’s Sports Bar in Bealeton. The O’Mearas originally started their tree farm in 1980 to help send their two sons to college! The boys have both graduated (Patrick from Lafayette and Timothy from Yale), thanks in part to income earned from the trees. They also learned a great deal about hard work and the basics of running a business, according to their parents. The family now donates the trees to local non-profits as fundraisers. The trees are in the Hearthstone parking lot <two miles west of Sperryville on Route 211) and are $25 for any size. n Trees can t>e picked up at any time as there is an honor-system drop box for payment. Because of the drought last year, some of last year’s trees dropped their needles; if this happened to a tree you purchased from Hearthstone, your tree this year is free (just drop a note with your name in the box). Obituaries Marshall M. Atkins Sperryville resident Marshall Monroe Atkins, 65, of Sperryville died Dec. 9 at his residence. He was bom April 11, 1938 in Sperryville to the late Monroe Kelly Atkins and Ella Catherine Atkins. Mr. Atkins retired from the Virginia Department of Transportation after 30 years and served in the U. S. Air Force during the Korean War. He was preceded in death by his wife, Nadine Dodson Atkins and one brother, Ned M. Atkins. Mr. Atkins is survived by two sons, Dean Atkins of Sperryville and Neal Atkins of Huntly and three grandchildren. Additional survivors include five brothers, Charles H. Frye, Kenneth C. Atkins both of Luray; Woodrow P. Atkins of Stanley, Robert E. Atkins of Warrenton and Ronald E. Atkins of Washington; two sisters, Charlotte A. Vaughn and Nancey C. Kellison, both of Luray.
