At his first court appearance Tuesday morning before General District Court Judge Charles Foley, Marshall was denied bail.
However, the judge will consider a bail motion on Jan. 6. A preliminary hearing is set for Feb. 3.
At the hearing, Marshall said he is on a VA disability and indicated he is not employed.
Luke said it appeared "the deceased died from a single gunshot wound to his head."
After the hearing, Luke was reluctant to discuss the facts of the case or motive because he didn't want "to taint the jury pool" selected for a trial.
"It’s a small county, word spreads fast," he said.
Marshall, who has one prior felony conviction, is currently in the Rappahannock County jail awaiting his Jan. 6 court date, officials said. His birthday is today.
Meanwhile, Marshall's dog has been taken by the Sheriffs Office to the county animal shelter, according to Luke, and Marshall has been asked if he would allow the dog to be adopted. They are awaiting an answer.
The last homicide in the county was March, 3, 1999 when an apparent dispute over money resulted in the shooting death of Willie Steve Nichols Jr., 28, of Boston at a home near Scrabble. Joseph C. Johnson, then 41, was charged and convicted of murder
The homicide before this 1999 one occurred 12 years earlier and involved a "domestic situation" in F. T. Valley, said Luke.
