EXTRACT from a decree of the Circuit Court of said County entered in the above entitled cause on the 29th day of December, 1962:
Upon consideration whereof the Court does hereby order, adjudge and decree that this cause be and the same hereby is referred to John W. Price, Jr., a commissioner in Chancery of this Court with direction to take, state and forthwith report an account showing the following:
First: Whether the deed purported to have been executed by J. Rufus Berry on the 24th day of June, 1949, to Joseph F. Berry, conveying a one-third undivided interest to 176 acres of land, should be set aside and declared void.
Second: Who are the owners of the 176 acres of land, the subject matter of this cause, and in what proportions.
Third: What liens are against the property, their priorities, and by whom held.
Fourth: What debts are against the estate of J. Rufus Berry, deceased, their priorities and by whom held.
