2. If he was at the time of his death receiving VA disability compensation, or would have been entitled to • VA compensation had he not been in receipt of retirement pay; or 3. If the official service records show discharge for a reason other than disabil-t ity, but also show disability due to service for which the veteran was receiving treatment at the time of discharge and the VA determines that the veteran could have taken a disability discharge. Even if the veteran was not under treatment at time of discharge, the VA is authorized to determine if the disability was of such nature and degree as to have - justified a discharge for a disability incurred in line of duty.
