Luke saick that he saw three reasons for jthe Supervisors to vote in favor of the rezoning. “This would not be in violation of the spirit or intent of the law. We’ve been through the procedures. Second, the new location would not change the character of the community. And third, Mrs. Latham’s house is not directly behind The proposed location for the gofrage and is obstructed by existing trees.”
Before a vote could be called, Commonwealth’s Attorney George Davis said that Elmer Jenkins didn’t have a recorded deed to both lots. “There is a recorded deed for one lot, from Marie Everett, in Jenkins’s name. But there's no deed of record from Banks and heirs to Jenkins,” Davis said.
Clerk E.M. Jones thought he remembered that such a deed had been recorded. He’d misled Jenkins if it hadn’t, Jones said, because he thought it had. “I’ve been over there and checked and 1 can’t find it,” Davis said.
Jenkins left the room to hurry over to the clerk’s office. Roger Batchedler, who’d helped him obtain the land, followed. Ned Jones also got up to go help them look.
