The following letter has been sent to Adm. J.M. Gardiner, chairman of the Board of Zoning Appeals of Rappahannock County, with a copy to the Board of Supervisors:
Dear Chairman Gardiner:
I am informed that the Supervisors of Rappahannock County voted on January 14, 1977, to resubmit to the Board of Zoning Appeals the Updike application for a special use permit relative to the tract of land near Scrabble, Route 522.
I have been requested to write you and respectfully state our position, to-wit: that in view of the unanimous decision of the Board of Zoning Appeals denying the Updike application, there is no basis under the Zoning ordinance or the laws of Virginia for the procedure adopted by the Supervisors. We consider that the decision of the Board of Zoning Appeals, issued after affording all interested persons the opportunity to present evidence and after full public hearing, has finally disposed of the Updike application.
As you know, the Zoning Ordinance (Section 16-7-1) and the Code of Virginia (Section 15.1-497) provide that any persons aggrieved by a decision of the Board of Zoning appeals must appeal with
