In many instances such as Federal acts regulating water pollution, sewage treatment, welfare services, and occupational health and safety regulations the state agencies are authorized by law to administer these acts instead of having Federal administration and the state has no discretion on deciding which regulations are to be adopted.
However, there are instances where the state agencies do have discretion and the bill I have introduced would be an important step in giving the local governments and the legislature an opportunity to review the costs that would be imposed on local governments before such requirements become effective.
I have introduced another bill which requires that all regulations adopted by state agencies shall state what specific provision of state law or Federal law or Federal regulations authorizes or requires such regulations. This would be helpful in determing whether the regulations are required by Federal or state law and whether the agency is required to adopt such regulations or is merely authorized to do so.
