No additional license shall be required for the privilege of selling soft drinks, confections, food, souvenirs and novelties on the grounds on which such shows are exhibited.
The provisions of this by-law shall not be construed to allow without payment of the tax imposed by law, performance for charitable or benevolent purposes or any other purpose by a company, association, or persons, or a corporation, who make it their business to give exhibitions^ no matter what terms of contract may be entered into or under what auspices such exhibition is given by such company, association or persons, or corporation for benevolent or charitable purposes or any other purpose, it being the intent and meaning of this by-law that every company, association or persons or corporations which makes its business that of giving exhibitions for compensation, whether a part of the proceeds are for charitable or benevolent pur* poses or not, alkali pay the license tax prescribed by law; nor shall the .provisions c4 this* by-law he construed to allow, without the payment of the State and local taxes, impoeed by law, exhibitions, or performances by a companyj association, persona -or corpora-i lions.
Every person, company or corporation whp or which exhibits or gives a performance of any of the shows above described in this by-law which, are aet exempt from license tax by the statute laws of the State of Virginia, without the license required by law, .shall bej fined.not lose than fifty dollam nor more than five hundred dollars for each offense. The police authorities of a town, city Or* county shall mot allow any suchj performance to open until the license required by law la exhibited to them.”
