Seating of Powell
Rep. John O. Marsh, Jr., said today that he voted on •Constitutional law and prece dent, and without regard to considerations of personality or politics" in the series of ballots taken in the House of Representatives Wednesday on the seating of Representative-elect Adam Clayton Powell of New York. “As is well-known, I hold no brief for improper conduct by this or any other individual elected to Congress," Marsh said; “and I voted, on the convening day of this 90th Congress, to have this elected prospective member from the 18th Congressional District of New York stand aside, pending investigation of his legal qualifications to serve. Additionally, in the Democratic caucus, I voted to deny this prospective member the committee chairmanship which he had held in preceding Congresses.
“I realize that some may interpret my votes of yesterdayi
as tending to countenance thej conduct complained of, but this! was not my purpose. It was my j hope that the recommenda-j tions of the select committee! would be amended to a form; which I could support on the! basis of my legal conclusions' in the matter, and to a form which I would be convinced would not be subject to overthrow by court action on Constitutional grounds. “My approach was legalistic and impersonal, and I continue ! to believe that this is the only proper approach totheques tion of seating, non-seating or expelling a member ofarepre sentative body of our government.
“There is evidence which I j believe requires the prompt j consideration of the Depart-' ment of Justice in this case, and it is my hope that the matter will be pursued diligently! within the framework of due process of law."
