Grand Jury indicts 2
ERNEST MOFFETT SMITH AND CHARLES CAMPBELL were indicted by a grand jury Monday after a preliminary hearing which lasted two days on one count of murder each, one count each of breaking and entering and two charges of robbery, each.
The charges were lodged recently against Smith and Campbell following a 17-month investigation of the slaying of John Swan Sutton of Arlington, who was discovered beaten to death at the Lom-Bar-Dy Lunch Room in Amissville in September of 1970. The lunchroom was also entered and burglarized and the person of Sutton was robbed.
The five-man grand jury returned a true bill and arraignment is scheduled for May 8 in Rappahannock County Circuit Court. Court-appointed counsel will represent both Smith and Campbell. A preliminary hearing took place Thursday and continued through Friday until late afternoon, at which time the court recognized the evidence as constituting a prima facie case and sent it to the grand jury.
' LEE PAYNE OF WOODVILLE was foreman of the grand jury, which was composed of G. Brown Miller of Sperryville, Frank Huff of Flint Hill, Gilbert Cosden of Sperry ville, and Edward Bailey of Washington.
Judge W.F. Moffett Jr., on the bench for the preliminary hearing, sent all of the cases to the grand jury held Monday. □
