Acting under end by virtue of the authority vested in us by decree of the Circuit Court of Rappahannock County, Virginia, entered on the 16th day of July 1973 in the pending chancery cause of Guy Foster v. Bertha A. Range, etuis, we will offer for sale at public auction,

Tract f 1: All that certain tract or parcel of woodland known as the “Gaither Woodland Tract”, containing two acres, more or less, and bounded by the lands of Moore, J. NewbUl Miller and Tyler.

Tract #2: That certain tract or parcel of land containing 3.S5 acres on the south side of Nixon’s Arm and described by survey of J E. Sutphin made on April 1,1903, as follows: Beginning at a Urge dogwood comer to W. A. Deatherage heirs, thence with their line N. 50 W. 14.11 chains to a pile of stone by a large locust, thence S. 77-1/4 E. 3.50 chains to a point in the road leading from the mountain, thence with the road, S. 52-1/2 E. 4.80 chains S. 63 E. 1.00 chain, S 85-3/4 E. 1.40 chains, N. 77 E. 2.50 chains, N 86-1/4 E 3.00 chains to a point in middle of said road opposite the end of stone fence, S 28-1/2 W. 6.82 chains to the beginning containing 3.85 acres.” The hereinbefore described tract of land is the same land acquired by Barnett Green from L. J. Moore, e* als, by deed dated February 11, 1903, and recorded in Deed Book W, page 100 of the Clerk’s Office aforesaid.

Tract #3: That certain tract or parcel of land on the south side of Nixon’s Arm containing forty and one-half (40-1/2) acres, more or less, and described as follows to-wit: “Beginning at a large rock corner to R. S. Bell in Dea the rage’s line, thence with said Bell N. 52 W. 18.29 chains to a pile of stone near a chestnut-oak, thence N 36-1/4 E. 18.49 chains to a Jesuit corner to said Moore, thence with said Moore S 83-1/2 E. 14.95 chains to a red oak, thence S 42 36’ E 7.42 chains to a point in Moore’s line on the top of Nixon s Arm, near a hickory and two bUzed oaks marked, thence S 39-1/2 W 23.83 chains to the beginning containing 44-1/2 acres. SAVE AND EXCEPT THEREFROM the following described tract or parcel of land conveyed by William B. Parnell, et ux, to Barnett Green by deed dated April 26, 1879, and recorded in Deed Book P, page 270, as described in said deed by survey of A. W. Utterback on May 11, 1878: “Beginning at a blazed or burt white oak in R. S. Bell’s line, thence N 36 E 3.75 chains to a stone 25 links N 36 of three small chestnut oak sprouts marked, thence S 57-3/4 E 8.77 chains to a pile of stone on the side of the mountain, thence S 21 W 5 chains to a stone near a small Hickory in said Bell’s line, thence with said Bell’s line N 51 W 10 chains to the beginning containing 4 acres.

The above described real estate is the same land conveyed to James Moore by William B. Parnell, et ux, by deed dated July 18, 1879 and recorded in Deed Book P, page 86, of the Clerk’s Office aforesaid; later incorrectly described as 44-1/2 acres in the partition of the EsUte of James Moore and allotted to James B. Deatherage and Thomas A. Deatherage in Deed Book T, page 272, et seq; and thereafter acquired by Barnett Green from Thomas Amiss Deatherage, et al, by deed dated July 26, 1900 and recorded in Deed Book V, page 67.

TERMS OF SALE: Said sale is to be made for cash and immediately after the time of purchase, the successful bidder or bidders of the respective tracU shall make a deposit of 10% of the purchase price of each tract to the credit of this Court in this cause in the Farmers and Merchants National Bank of Winchester, General Receiver of this Court, and the receipt or receipts showing said deposits shall then be forthwith delivered to the Commissioners appointed herein.
