Weil still maintained that it wasn’t necessary to reapply under Article 12b of the zoning ordinance. Article 12b only applies to agricultural and conservation zones and the ski area is already considered a commercial zone, he said. And the requirements of 12b would be enforced by the homeowners association anyway, he said again. In fact, the by-laws of that organization would be stronger than the ordinance, Weil said.

But George Muth was adamant. He wanted Weil to present specific plans to the planning commission before the request even came back to the zoning appeals board. And Muth emphasized, the rules of the homeowners association could change with the membership, so that was no guarantee.

So the planners scheduled a special session and Weil returned Tuesday night. He met many of the same questions as he had at the earlier meeting of the zoning appeals board.

Newbill Miller pointed out that Weil had said earlier that he planned to sell interests in the year-round area resort to 1,500 eventual owners, who would all hold deeds and be “tenants in common.” A deed would guarantee each owner a site on which to park his camper trailer for no more than 15 of every 30 days. Weil nodded that Miller was representing his proposal correctly. But, Miller then asked, what is to prevent these owners from sub-letting their lots. That would mean all 1,500 lots could be filled with trailers all the time. Weil didn’t have an answer for that one.
