Another Board member, George Muth, instead moved that the Appeals Board adjourn in order to get legal counsel on the need to readvertise the permit application should the Board of Supervisors become joint petitioners for the landfill. Again, Davis emphatically stated that readvertising would not be necessary. Muth’s motion to adjourn was quietly seconded by Forward. Davis again demanded that his motion be considered. There’s no question in the world that the Supervisors have legal standing to be a party to the application,” he stated.
“There is a question in our mind and you are not running this meeting,” Chairman Gardner countered. Davis, who does not sit on the Board of Zoning Appeals, can not make a motion and when Gardner asked if any Board members would like to entertain Davis’s motion, there was silence in the room. The question was called on the motion to adjourn and with a quick unanimous voice vote the meetine closed.
