Charges of penury against Brian William Wayland were dismissed in Circuit Court last Thursday.
Mr. Wayland was charged with perjury for testimony he gave in the trial of Chris Hitt, who was found guilty of hiaking an obscene telephone call last Dec 31 or Jan. 1, when he was a juvenile. Mr. Hitt is now an adult. Mr. Wayland had provided an alibi for Mr. Hitt in his trial last March. , Commonwealth’s Attorney Peter Luke had three witnesses for the prosecution. Ellen Mustoe, juvenile probation officer, testified that she had heard Mr. Wayland testify that Chris Hitt was with him from December 31 at 11 a.m. until after lunch on Jan 1.
