A commonwealth’s attorney is quoted as saying, upon a dismissal, that it is not known what is done at the factory to pre-sterlllzed needles apd that a physician had stated that “needles good enough for sick people are also good enough for drunks." It does appear that this is a medical rather than a legal problem. When a person wishes to marry in Virginia, he must submit to a blood test. He is not forced to submit, but if he will not, he may not marry in Virginia. Similarly, under implied consent, the driver is not forced to submit but it is presumed he promises to submit, under arrest, if he accepts the driving privilege. Suppose that a marriagelicense applicant tests positive. If implied consent provisions applied, he could get the test thrown out on a technicality and marry, despite the positive test. A drinking driver has the protection other people submitting to tests for other purposes do not have. No matter how high might be his concentration, failure to sterilize a needle means freedom.
